AND PROTECTIVE COVENANTS FOR
PORTER CREEK SUBDIVISION

This Declaration of Architectural Controls and Protective Covenants made and published this 3o day of December, 1999, by Robert H. Smith, of Oconee County, Georgia.
WITNESSETH
WHEREAS, Robert H. Smith is the owner of certain real estate located in Oconee County, Georgia which real estate is more particularly described in Exhibit "A" attached hereto and incorporated herein by reference, and which real estate is known as Porter Creek Subdivision; and
WHEREAS, it is to the interest, benefit and advantage of said owner and each and every person who shall hereafter purchase a lot or lots in said subdivision that certain architectural controls and protective covenants regulating and governing the use and occupancy of said property be established, set forth and be declared covenants running with the land;
NOW, THEREFORE, for and in consideration of the premises and of the benefits to be derived herefrom, said Declarant, does hereby set up, establish, promulgate and declare the following architectural controls and protective covenants to apply to all of said lots, and to all persons owning said lots, or any of them hereafter; these protective covenants shall become effective upon the date of recording of this Declaration and shall run with the land and shall be binding on all persons claiming under and through said Declarant until such time as said covenants may be extended, modified or terminated in whole or in part as hereinafter provided.
ARTICLE ONE: DEFINITIONS
1.1 Declarant. The "Declarant" is Robert H. Smith, his respective heirs, executors, administrators, successors and assigns.
1.2 First Mortgagee. "First Mortgagee" shall mean the holder of any Deed to Secure Debt granting a security interest in any Residential Lot, or any portion thereof, which security interest is superior to any other security interest in the same property. The term 'First Mortgageet shall also be deemed to include the heirs, executors, administrators, successors and assigns of the holder of any such Deed to Secure Debt.
